These Terms of Service ("Terms") govern your access to and use of the Tracklete mobile app, web dashboard, and marketing website (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.
If you do not agree, do not use the Service.
Tracklete ("we", "us", "our") is a fitness coaching platform that allows professional coaches to manage their clients, build training programs, schedule sessions, and track progress. Clients use Tracklete to view assigned programs, schedules, and goals set by their coach.

You must be at least 16 years old to use Tracklete. By creating an account, you confirm that you meet this minimum age requirement and have the legal capacity to enter into these Terms in your country of residence.
If you are using Tracklete on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.
To use Tracklete, you must create an account by providing a valid email address and password. You are responsible for keeping your login credentials confidential. Notify us immediately at support@tracklb.com if you suspect unauthorized access to your account.
You agree to provide accurate, current, and complete information when registering and to keep it updated.
You may not create multiple accounts to circumvent restrictions or trial limits.
Coaches must subscribe to use Tracklete after their free trial ends:

Pricing is subject to change with at least 30 days' notice to active subscribers.
The payment method depends on the platform you subscribe from:
We do not store credit card information. For Whish payments we do not auto-charge; for Apple In-App Purchases renewal and cancellation are managed by Apple, and for Google Play by Google.
Apple In-App Purchase (iPhone): subscriptions auto-renew each billing period until you cancel them in your Apple account settings.
Google Play (Android): subscriptions auto-renew each billing period until you cancel them in the Play Store.
Whish Money (manual): subscriptions are pre-paid for a fixed number of months and do not auto-renew. Nothing renews them for you and we will not charge you again. When the period you paid for ends, your account is paused — read-only access, and no data is lost — until you make a new payment. You can re-subscribe at any time to restore full access.
Refunds are evaluated on a case-by-case basis. If you are not satisfied within the first month of a paid plan, contact support@tracklb.com with your account email, subscription details, and reason for the request. We aim to respond within 7 business days. For Whish Money payments, approved refunds are issued via Whish; for Apple In-App Purchases, refunds are handled by Apple under its refund policy.
New coach accounts receive a 14-day free trial with everything in Max — every feature we offer, including unlimited clients, the AI program generator and custom exercise videos. Trials are limited to one per person/email. The trial does not convert into a paid plan on its own and you will not be charged when it ends; the account simply becomes paused until you choose and activate a subscription. All your data is preserved during this period.
Coaches enter and manage client information (display names, programs, payments, workouts) through Tracklete. Coaches are responsible for:

Tracklete is a software platform. We do not provide fitness, medical, or nutritional advice. All training content comes from the coach using the platform. Always consult a qualified medical professional before starting any new exercise program. Tracklete is not responsible for injuries, health outcomes, or coaching quality.

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.
The Tracklete brand, logo, app design, source code, and underlying technology are owned by us. You may not copy, modify, distribute, or create derivative works without written permission.
You retain all rights to the content you create on Tracklete (programs, exercises, notes, client data, etc.). By using the Service, you grant us a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the Service to you.
You are solely responsible for the content you upload and warrant that you have the right to do so.
We aim to keep the Service available 24/7 but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, infrastructure issues, or force majeure events. We are not liable for any losses resulting from downtime.
We may modify, suspend, or discontinue any part of the Service at any time, with reasonable notice when feasible.
You may delete your account at any time through the app's settings. Deletion is permanent and irreversible. What is erased and what is kept differs between coaches and clients — in particular, a client's completed training history is retained in their coach's account with the client's identity removed. Section 5.2 above and section 6 of our Privacy Policy set this out in full; read them before deleting.
We may suspend or terminate your account if:

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will be error-free, uninterrupted, or secure, or that defects will be corrected.
Health disclaimer: Tracklete is not a medical service. Training programs and advice are provided by coaches, not by Tracklete. Always consult a qualified healthcare provider before beginning any new exercise regimen. We are not responsible for any injuries, health conditions, or outcomes resulting from use of the Service.
To the maximum extent permitted by applicable law, Tracklete shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Service.
Our total liability for any claim relating to the Service shall not exceed the total amount you paid us in the twelve (12) months preceding the event giving rise to the claim.
You agree to defend, indemnify, and hold harmless Tracklete and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

These Terms are governed by and interpreted in accordance with the laws of Lebanon, without regard to its conflict-of-laws principles. Any disputes arising from these Terms or the Service shall be resolved in the competent courts of Beirut, Lebanon.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
